The client commissions the agency Luxury Event Mallorca represented by Mareike Jakél with the decorative services described in the offer.

By paying the deposit, the client agrees to the terms and conditions and the offer. The order commences upon receipt of payment to Luxury Event Mallorca. 

Decorative items:

The decorative items named in the offer such as vases, lanterns, seat cushions, torches, lighting, jukebox, etc. are rented and are not included in the purchase price. If items are damaged or lost, they must be replaced. The prices include the costs of delivery, organisation and cleaning. The flowers include both real and synthetic flowers (depending on the package). The fresh bouquet for your loved one is included in the package and can of course be taken home.

Booking on a weekend (Saturday/Sunday) or public holiday

A separate flat rate of €100 + VAT will be charged for bookings on weekends or public holidays.

Hourly rate for additional services

If additional services are required, e.g. booking of shuttle service, arrangements with photographers who are not part of our portfolio, etc., the hourly rate will be charged at 45 € + VAT.

If the package time is spontaneously extended on site, the hourly rate is €150 + VAT. 

Location - Moving to another location

The locations we suggest are included in the offer. If you want us to come to your neighbourhood or look for a different location, a travel fee of €200 + VAT and/or location scout would be added. 

Change due to bad weather for packages from our website

If the marriage proposal has been arranged outside (outdoors) and cannot take place due to bad weather, this must be discussed at least 1 day before the proposal. A service fee of 80 € + VAT will be charged for a change of booking to an indoor location and another package.

Change due to bad weather for customised packages

If the marriage proposal has been arranged outside (outdoors) and cannot take place due to bad weather, this must be discussed at least 5 days before the marriage proposal. For a rebooking to an indoor location and another package, a service fee of 10% of the order volume (Minimum 100 € + VAT) will be charged. If the new organisation causes a considerable effort, the flat rate is to be discussed separately.

For own location/ hotel/ finca/ access:

The client guarantees that Luxury Event Mallorca by Mareike Jakél has access to the agreed locations and sites and that sufficient time is available for set-up and dismantling.

Set-up and delivery:

The decoration will be delivered before the marriage proposal as agreed. Depending on the size, at least 1-2 hours or more should be allowed on site for set-up. Dismantling also takes around 1 hour.

In accordance with the provisions of Law 15/1999, of 13 December, on the Protection of Personal Data, the client is informed and expressly accepts that the personal data will be incorporated into the electronic databases of Luxury Event Mallorca by Mareike Jakél, where the data will be kept confidential, subject to mandatory communications.

This data will be used in accordance with the aforementioned law for the management of the commercial and legal relationship between the parties and for the following purposes:

- Organisation of event and decoration work, preparation of offers and invoices by Luxury Event Mallorca by Mareike Jakél and service providers as well as general correspondence and communication.

The owner of the personal data gives his consent to Luxury Event Mallorca by Mareike Jakél to pass on and disclose his necessary data (name, address, tax number/ID number, etc.) in connection with the event planning to the respective service providers (catering, music, location, etc.) for the purpose of processing and providing the respective own services.

The provision of personal data is voluntary. 

This is valid for an indefinite period and can be cancelled at any time with effect for the future. 

In this case, the owner sends the cancellation in writing to Luxury Event Mallorca SL - Mareike Jakel.

Force majeure: Luxury Event Mallorca by Mareike Jakél is not liable for service disruptions due to force majeure or circumstances for which it is not responsible. Nor for any complication, endangerment or impairment of a significant nature, in particular due to unforeseeable circumstances such as obstruction by state authorities or other persons, road blockades or quarantine measures, entry regulations, etc.

Liability:

The liability of Luxury Event Mallorca by Mareike Jakél - with the exception of cases of intent and gross negligence - is excluded. Luxury Event Mallorca by Mareike Jakél accepts no liability for loss of or damage to items belonging to clients or guests. 

Furthermore, Luxury Event Mallorca by Mareike Jakél is not liable for third parties or commissioned companies. The client undertakes to indemnify the agency against any claims for damages by third parties arising from or in connection with the organisation/decoration of the event. All processes are coordinated to the best of our knowledge and belief.

Confidentiality: 

In general, the secrecy of fees applies to individual packages. The client also undertakes not to pass on ideas, thoughts, format templates and designs to third parties on the basis of copyright and not to use them commercially himself.

Dismantling/collection of the items:

Once the marriage proposal has taken place, we have arranged a "time to enjoy" for you. This is usually 1 or 2 hours per package. The decoration will be dismantled after the agreed time. We will come to you at the end of the time. If you would like to leave earlier, please let us know. We will then come to you and ask you not to leave the items unattended.

Cancellation less than 14 days before the proposal: € 250 + VAT. In case of a rebooking 120 € + VAT.

In the event of cancellation 2 days or more before the marriage proposal, 70% of the order volume will be waived as a cancellation fee. The client shall also reimburse any costs already incurred by purchases, purchases, etc. for the event.

In the event that Luxury Event Mallorca suggests an alternative date and discusses it with you, the rebooking is of course free of charge.

Food and drinks:

We provide food from restaurants or food market. Luxury Event Mallorca by Mareike Jakél accepts no liability for the food. Please inform the client of any allergies and intolerances in good time in the questionnaire.

Should something not be to the client's taste, the client should inform us immediately when tasting the food. The client shall indemnify the contractor against any subsequent complaints. 

If it is a dish that is generally difficult to eat if you have dental problems, the caterer and the guests themselves are advised to chew carefully.

Should individual or several provisions of this agreement between Luxury Event Mallorca by Mareike Jakél and the client be or become invalid, this shall not affect the validity of all other provisions or agreements. Instead, the invalid provision shall be replaced by a provision that corresponds to the economic sense and purpose of the invalid provision in a legally permissible manner.

Status 01/2024Disputes:

We will always endeavour to find a joint solution and invite you to a harmonious discussion. In the event that this is not possible, the place of jurisdiction and fulfilment is Palma de Mallorca - Islas Baleares.

Final provision:

Should individual or several provisions of this agreement between Luxury Event Mallorca by Mareike Jakél and the client be or become invalid, this shall not affect the validity of all other provisions or agreements. Instead, the invalid provision shall be replaced by a provision that corresponds to the economic sense and purpose of the invalid provision in a legally permissible manner.
