The client commissions the agency
Luxury Event Mallorca SL represented by Mareike Jakél with the organizational services described in the offer. By paying the down payment, the client agrees to the information and general terms and conditions as well as to the offer.
The start of the order and the reservation of our service for you takes place with the receipt of the deposit of 35% of the agreed services in this offer.
1) Luxury Event Mallorca SL by Mareike Jakel does not act as an organizer, but organizes and coordinates the processes of the event according to the offer and offers the implementation of the decoration. For this, the agency receives a lump sum as shown in the offer. It supports the clients in consultation according to their wishes and offers the services as listed above in the offer.
2) Event planning: As soon as the location and the date for the event have been determined, concrete event planning begins. The offer from Luxury Event Mallorca SL by Mareike Jakél includes the entire planning and concept creation for the specified location and this date. If the client changes the event planning and wants a new location or a new date, a new offer will be made for this with the corresponding additional effort for the organization of the event.
3) Submission: The client submits the final number of guests no later than 3 weeks before the day of the event. In the case of a detailed guest list, this will be sent around 4 weeks in advance. Seating plans or other special requests from clients and guests (microphones, etc.) are also submitted no later than 3 weeks before the day of the event. The exact information for the shuttle at least 4 weeks in advance.
4) Shuttle: We recommend reserving the shuttle buses in advance. The exact number of guests can then be adjusted again 4 weeks before the event (for this we need the exact information on the accommodation and number of people). Luxury Event Mallorca SL by Mareike Jakél will occasionally call taxis, but not for the entire company of the event. We recommend booking the shuttle service for this.
If no shuttle is booked, guests are required to organize their own trips.
5) Hotels: We do not make hotel bookings. On request, we can make recommendations for hotels that are tailored to the overall concept.
6) In the event of bad weather and the associated additional work or rescheduling, this must be discussed at least 5 days before the start of the event. If significant additional work is required due to short-term changes, a flat rate of €450 will be charged. If additional staff is required or requested, this will be charged at €350 per day.
7) The offer was created based on the number of guests stated in the offer. Each additional guest will be charged a surcharge of €20 for organizational expenses.
8) From a working time of more than 5 hours on the day of the event, the client agrees to take over the catering of the respective employees. Usually this amounts to around €30-50 per person.
9) The terms of payment are as follows: 35% at the beginning of the order, 40% four months before the event, 25% 7 days before the event by bank transfer or at the latest on the day before the event begins. (Customized payment runs may have been noted in your personalized offer).
For short-term bookings (from 3 months before the event), the terms of payment are as follows: 50% at the beginning of the order, 30% one month before the event, 20% 7 days before the event by bank transfer or at the latest on the day before the event begins.
10) The liability of Mareike Jakél - with the exception of cases of intent and gross negligence - is excluded. Luxury Event Mallorca SL by Mareike Jakél assumes no liability for loss or damage to property belonging to clients or guests.
Furthermore, Luxury Event Mallorca SL by Mareike Jakél is not liable for third parties or commissioned companies. The client undertakes to indemnify the agency against any claims for damages by third parties arising from or in connection with the organization of the event. All processes are coordinated to the best of our knowledge and belief.
11) The client confirms that he and his guests will comply with the legal requirements of the Spanish government and the Balearic Islands. In particular, this applies to noise protection regulations and decibel requirements (if these are required at the location).
The client is informed that after midnight, volume or music may only take place in closed rooms. Event planning will take this into account and adjust accordingly.
12) Data protection for clients: I agree that my data (personal data such as name, address, telephone number, copies of ID cards/ID card number, tax number, etc.)
stored, processed and used for the following purposes:
- Organization of the event and preparation of offers and invoices by Luxury Event Mallorca by Mareike Jakél and service providers as well as general correspondence
For this purpose, Luxury Event Mallorca SL by Mareike Jakél may forward the data (name, address, tax number/ID number, etc.) to the respective service providers (catering, music, location, etc.).
Providing personal data is voluntary.
This applies indefinitely and can be revoked at any time with effect for the future.
In this case, I will send my declaration of revocation in writing to Luxury Event Mallorca SL - Mareike Jakel.
If the client transfers personal data from third parties (e.g. guest lists) to Luxury Event Mallorca SL by Mareike Jakél, point 11 of the General Terms and Conditions also applies.
13) Confidentiality: If the client is asked by third parties for the contact details of the intermediary service providers, these may only be passed on by the agency of Luxury Event Mallorca SL by Mareike Jakél. The client undertakes not to pass on the names and contact details of the service providers that Mareike Jakél mediates to third parties and not to use them for commercial purposes. In general, fee secrecy applies.
The client also undertakes not to pass on ideas, ideas, format templates and designs to third parties on the basis of copyright and not to use them commercially himself.
14) Decoration: The decoration will be made in a separate offer. The decorative items such as vases, lanterns, seat cushions, lighting, etc. are rented and do not constitute a purchase price.
The prices include the costs of organisation, cleaning and delivery of the candles and flowers.
15) The client agrees to always promptly communicate feedback, changes or news that are important for event planning, support or follow-up and to participate in the exchange of necessary emails and telephone calls with Luxury Event Mallorca SL by Mareike Jakél . Respectful, friendly manners are observed.
16) Feedback on offers: As soon as Luxury Event Mallorca SL by Mareike Jakél has checked the availability of a service from a third party and an individual offer has been created for the client, the client will give feedback on the offer and the booking at short notice (at the latest within one week ). A binding reservation of the trades and services is only made after receipt of a reservation payment. If the client delays the bookings/does not give any feedback and the availability expires again, Luxury Event Mallorca SL by Mareike Jakél will obtain a maximum of 2 offers per service. In the case of short-term inquiries, the availability of trades cannot be guaranteed.
17) The agency has negotiating and closing powers for the client and may promise and coordinate contracts (e.g. location, catering, technology, etc.) for him (this only takes place after prior approval by the client). As a rule, the service providers have their own terms and conditions which relate to their service. The respective trades are commissioned after a down payment has been made.
18) Major changes: If the client makes major changes to extensive plans or cancels them and this results in considerable additional work, he will reimburse the agency for all costs incurred or the agency is entitled to subsequently charge a reasonable flat rate.
19) Location: If the selected location has not yet been determined at the start of the order and is more than 30 km from Palma, a flat-rate travel fee of €150 will be charged. From a distance of 45 km from Palma, 200 € travel costs are estimated. If the location has special requirements (additional expenses), the offer can be adjusted again accordingly. In this case we would discuss it.
20) Force majeure: Luxury Event Mallorca SL by Mareike Jakél is not liable for performance disruptions due to force majeure or circumstances for which she is not responsible. And not for aggravation, danger or impairment of a significant kind, in particular not due to unforeseeable circumstances such as e.g. B. Obstruction by state organs or other persons, road blockades or quarantine measures, entry requirements.
If the government of the Balearic Islands has set hygiene rules or rules in the course of meetings at events that affect the execution of the event, Luxury Event Mallorca SL by Mareike Jakél will adapt and implement the necessary measures to the best of our knowledge and belief. The client assures that he will comply with the rules and will also ensure that guests also comply with the rules and instructions and take note of them.
21) Disputes: We will always try to find a common solution and invite you to a harmonious discussion. In the event that this should not be possible, the place of jurisdiction and performance is Palma de Mallorca - Islas Baleares.
22) Termination: If the client wishes to terminate the agreement prematurely or the event cannot take place, Luxury Event Mallorca SL by Mareike Jakél will be billed for the expenses incurred up to that point. The termination is agreed in writing.
If the notice of termination is less than six months before the event and/or the planning has already progressed, the agency is entitled to at least 50% of the agreed flat rate. If this is less than eight weeks before the event, the agency is entitled to the full agreed flat rate.
The agency has the right to terminate the contract if agreed installments are not paid by the client by the due date, the client does not fulfill the agreed points of the general terms and conditions, or for an important reason.
23) Cancellation: If the event is completely canceled in addition to the termination, an additional service fee of €250 will be agreed for the administrative cancellation of services by the service providers.
24) Rebooking: If the already fixed date is to be moved to a new date, for example due to force majeure, the following compensation for the expenses of the rebooking is agreed:
More than 8 months before the event = 250€,
7 to 5 months before event = 350 €,
less than 4 months before the event = €450.
25) The prices stated in the General Terms and Conditions are exclusive of Spanish VAT.
26) Final provision: Should one or more provisions of this agreement between Luxury Event Mallorca SL by Mareike Jakél and the client be or become invalid, the validity of all other provisions or agreements will not be affected. Rather, instead of the ineffective provision, a provision should apply that corresponds to the economic sense and purpose of the ineffective provision in a legally permissible manner.
